Terms & Conditions of Service

Who we are & our mission

Founded in 2019 by Brandon and Brittany, Pure Disposal is a family-owned SWFL company committed to respectful, reliable, and environmentally responsible junk removal. When you choose us, you help preserve the beauty of our home community.

Acceptance of terms

By scheduling and using our junk removal services, you agree to these Terms & Conditions. If you do not agree, please do not schedule or use our services.

Scheduling & access

  • Items must be clearly identified and safely accessible at the time of service (driveways, hallways, elevators cleared).
  • You authorize our team to access the service area and remove listed items. If gate codes, parking permits, or building approvals are required, please arrange them in advance.
  • We may photograph items/areas for estimating, proof of service, training, safety, and dispute resolution.

Estimates, pricing & adjustments

  • Pricing is based on volume, weight, labor time, access/haul distance, disposal/recycling fees, and item type.

  • Photo/phone estimates are non-binding; on-site assessments prevail.

  • Pricing may be adjusted upon arrival if actual scope differs from the original estimate (quantity, item type, access, stairs/elevators, disassembly required, etc.).

  • A firm, written total will be presented before we begin work.

Prohibited & restricted items

For safety and compliance, we do not accept hazardous materials, including but not limited to: paints/solvents, oils/fuels, pressurized tanks, chemicals, medical/biohazards, explosives, fireworks, suspected asbestos/lead, and uncontained sharps. Certain items (e-waste, refrigerators/ACs with refrigerants, pianos, safes, hot tubs) may require special handling fees or advance notice.

Donations & recycling

We strive to donate and recycle whenever local facilities and charities can accept items. Acceptance is not guaranteed and depends on condition, demand, and facility rules. If donation/recycling isn’t feasible, items will be disposed of at permitted facilities.

Ownership & authorization

You confirm you have the legal right to authorize the removal and disposal of all items and that items are free of personal property/documents. We are not responsible for items removed with your authorization.

Preparation, safety & conditions

  • Please empty drawers/containers and disconnect water/electrical lines in advance, unless otherwise agreed in writing.

  • We reserve the right to refuse service for unsafe conditions, infestations, hazardous substances, structural risks, or non-compliant items.

Payment terms

  • Payment is due upon completion unless otherwise agreed in writing.
  • We accept approved forms of payment presented at the time of service; returned payments may incur fees.
  • Balances not paid when due may be subject to late charges and collection costs as permitted by law.

Cancellations, rescheduling & wait time

  • Cancellations with less than 24 hours’ notice may incur a cancellation fee.

  • If the crew cannot gain safe/reasonable access within a reasonable wait period, a trip charge may apply.

  • Weather or events beyond our control (see “Force Majeure”) may require rescheduling.

Property protection & limitations

We use reasonable care and common protective measures (e.g., door/floor protection) and perform services in a workmanlike manner. Junk removal services are provided “as-is,” and we are not liable for pre-existing damage, latent structural issues, normal wear from moving large items, or damages not caused by our gross negligence.

No warranties; limited liability

Except as required by law, we make no warranties, express or implied. To the maximum extent permitted, our liability for claims arising from services is limited to the amount you paid for the specific service at issue and excludes incidental, indirect, special, or consequential damages.

Photos, reviews & marketing

With your permission, we may use non-identifying before/after photos for marketing. You grant us a non-exclusive license to use voluntary reviews/testimonials you submit, without personal contact details, in marketing materials. You can revoke permission in writing at any time for future use.

Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., severe weather, accidents, road closures, power outages, supply limitations, labor disruptions, government actions).

Governing law & disputes

These Terms are governed by the laws of the State of Florida. Venue for any dispute shall be in the state courts of Lee County, Florida, unless otherwise required by law. Before filing suit, parties agree to attempt good-faith resolution.

Severability & updates

If any provision is found unenforceable, the remaining provisions remain in effect. We may update these Terms from time to time; the latest version will be posted on our website. Continued scheduling or use after changes constitutes acceptance.
